Is NOM-035 mandatory for my company in Mexico?

Yes. NOM-035-STPS-2018 applies to every employer in Mexico, and what you owe scales with headcount. Up to 15 workers you must publish a psychosocial risk prevention policy and act on severe traumatic events. From 16 workers you must also formally identify and analyse psychosocial risk factors, using the Guía de Referencia II questionnaire (46 items). Above 50 workers you must additionally evaluate the organisational environment, using Guía de Referencia III (72 items).

How often do we have to apply the NOM-035 questionnaire?

At least once every two years. That is the floor, not the recommendation: two years is long enough for a team to churn completely between measurements, which is why most HR teams keep a short monthly or quarterly pulse running between the formal applications and use it to catch a problem while it is still cheap to fix.

What can the STPS fine us if we have no NOM-035 evidence?

Between 250 and 5,000 UMA per infraction under Article 992 of the Ley Federal del Trabajo. At the 2026 daily UMA of $117.31 MXN that is $29,328 to $586,550 MXN. An inspector can cite several infractions in a single visit and each one is fined separately, and severe cases can trigger a temporary shutdown.

How long does the NOM-035 questionnaire take an employee to answer?

About 15 minutes for the 72-item Guía de Referencia III and about 10 minutes for the 46-item Guía de Referencia II. A regular pulse survey is a different instrument: 3 to 5 questions, roughly two minutes. Sending the legal questionnaire on a weekly cadence is the fastest way to lose your response rate.

Are anonymous employee surveys actually anonymous?

In Bloomder the link between a person and their answers is destroyed in the same database transaction that saves the response, so there is no committed state where the two exist together. On top of that, no result is shown for a team or segment until at least 5 people in it have responded, and no administrator can lower that floor.

How do we survey employees who have no company email address?

Each person gets a one-time link that opens in any phone browser, with no app to install and no corporate login. A personal email address works, and so does a QR code by the time clock, a break-room screen or a shift-handover message. That is how plants, hospitals and multi-site retail teams reach staff who never sit at a desk.
